Failure to do so may result in deletion of your ad/s.  If you are under the age of 18 years old, you must obtain your parent's consent before using the SwapGiant.com’s services.  <br><br>

You agree that SwapGiant.com makes no claim as to the accuracy or reliability of any information obtained using any of the services of SwapGiant.com. <br><br>

You agree that SwapGiant.com is not liable or responsible for the content of any ad/s and/or any reply to any ad/s, and is not responsible or liable for conduct, directly or indirectly, relating the use of any services provided by SwapGiant.com.  You also agree that SwapGiant.com is not responsible for resolving any disputes that might arise between any two people placing and/or replying to any ad/s, or third parties involved in any transactions. <br><br>

You agree that you will not use SwapGiant.com's services to engage in unlawful, harassing, libelous, abusive, threatening, or obscene communications of any kind, or
communications which infringe or violate any third party's legal rights, or any communications that could constitute a criminal offense, or otherwise violate any applicable law or regulation; or, that are otherwise objectionable, or that promotes
illegal activities or physical, or mental harm against anyone. <br><br>

You agree that you are solely responsible for your actions while using any of SwapGiant.com’s services, and for any communications to or from you, or arising from the use, directly or indirectly, of any of  SwapGiant.com’s services.  <br><br>

You agree that SwapGiant.com is not liable to you or any third party for the temporary or permanent unavailability of the Service. <br><br>

You agree that you will not collect, through any means, any data from SwapGiant.com for anything other than what it was intended to be used for, and that you will adhere to all applicable local, state, national, and international laws and regulations as they relate to any actions your are performing while engaging in any activities, directly or indirectly related to the services provided by SwapGiant.com. <br><br>

You agree not to resell for commercial or personal purposes, SwapGiant.com’s service, use of its service, or access to the service. <br><br>

You agree that SwapGiant.com has the sole right and discretion to remove any material that appears to violate any of the foregoing, and that it may immediately notify the proper authorities upon the violation of any applica <br>ble laws. <br><br>

You agree that SwapGiant.com has the sole right and discretion to change, revise, alter, suspend, or delete any ad at any time, for any reason, without notice to you and without any liability to you or any third party. <br><br>

You agree that proprietary rights content available through SwapGiant.com includes, but is not limited to, text, graphics, software, music, sound, photographs, and videos, and any content provided by any third party advertiser, is protected by copyrights, trademarks, service marks, patents or other proprietary rights or laws. SwapGiant.com does not claim ownership of the content you transmit through SwapGiant.com’s services. By transmitting content through SwapGiant.com’s services, you grant SwapGiant.com a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the content for the purpose of promotion or any other legal activity. <br><br>

You agree that SwapGiant.com has the right to include a promotional tag line in every message, the content of which may be changed from time to time at SwapGiant.com’s sole discretion. <br><br>

You agree that any advertisements or promotions from third parties while using any of SwapGiant.com’s services, or any dealings with any third parties as a direct, or indirect, result of the using of SwapGiant.com’s services, including but not limited to, the payment for and delivery of goods and services, any terms, conditions, warranties, or representations associated with your dealings with third parties are solely between you and the third party. SwapGiant.com does not make any representations or warranties with respect to any dealings, or any goods or services which may be obtained from any third parties, and you agree that SwapGiant.com shall have no liability for these dealing, or goods, or services. <br><br>

You agree that you use all services provided by SwapGiant.com at your sole responsibility, and at your sole risk. <br><br>

You agree that SwapGiant.com’s services are provided and used by you pursuant to all applicable local, state, national, and international laws. <br><br>

You agree that any information or data obtained in any way through the use of SwapGiant.com, directly or indirectly, is done so at your own responsibility, and at your sole discretion. <br><br>

You agree that SwapGiant.com does not give any warranties of any kind, whether expressed or implied, of any goods or services obtained, directly or indirectly, as a result of your use of SwapGiant.com’s services. <br><br>

You agree to release SwapGiant.com and all of it’s, including but not limited to, parents, officers, directors, employees, agents, subsidiaries, and affiliates, of all liability, including but not limited to, any damages or losses of any kind resulting of the use, or inability to use, any services provided by SwapGiant.com. <br><br>

You agree that SwapGiant.com is not responsible, nor liable, to you or anyone, for the statements, communications, or conduct arising from the services provided by SwapGiant.com. <br><br>

You agree to indemnify, defend and hold harmless SwapGiant.com, including but not limited to, parents, officers, directors, employees, agents, subsidiaries, and affiliates, and their respective, including but not limited to, parents, officers, directors, employees, agents, subsidiaries, affiliates, and suppliers from any, including but not limited to, claim, action, or damage, or attorney's fees, made by any third party arising out of, directly or indirectly, your use of the services provided by SwapGiant.com, or your violation of this agreement, including but not limited to, the infringement by you or any other user, of any intellectual property or other right of any person or entity. <br><br>

You agree that this agreement shall be governed to the fullest extent by, and construed in accordance with, all local, state, national, and international laws.  You agree that you will bring any claim or cause of action arising out of your use, directly or indirectly, of the services provided by SwapGiant.com, or this agreement, to the courts located within the County of Orange, California, United States of America,  and you also agree to submit to the jurisdiction of those courts. <br><br>

You agree that any claim or cause of action arising out of your use of any of the services provided by SwapGiant.com, or this agreement, must be filed within one year after such time the claim or cause of action arose, or it shall be forever dismissed, notwithstanding any other law to the contrary.<br><br>
